The Government has responded to the petition as follows.
Thank you for your e-petition asking for the above change in the law concerning equine crime. The Government would like to highlight the following points in response:
Within the broad statutory framework decided by Parliament, sentences in individual cases are for the courts to decide, taking into account all the details of the offence and the offender, together with any aggravating or mitigating circumstances and any sentencing guidelines. The independence of the judiciary is an important principle of our criminal justice system, and so it would not be appropriate for Government Ministers to interfere in their decision-making.
To inflict unnecessary suffering on an animal, whether it is a pet or not, is abhorrent and is an offence by law. The Government?s abhorrence of such cruelty to animals was one of the reasons why it recently updated the legislation relating to the welfare of animals. Under the Animal Welfare Act 2006, it is an offence either to cause unnecessary suffering to an animal, or to fail to provide for the welfare needs of an animal, under the control of man, with a maximum sentence of 6 months? imprisonment or a £20,000 fine, or both. The Government does keep penalties under review.
Broadly speaking, whether an offence is tried in the Crown Court or in a magistrates? court depends on the likely sentence. It is only the most serious of offences, such as murder or rape, that are triable only in the Crown Court.
It is disgusting that a people could be so cruel to a trusting, defenceless animal... and an outrage for them then to pretty much get off with it. what does that say about our justice system? What is wrong with the world?? i will be printing of a petition.
I'm so sorry for your loss. Your heartache must have compounded by these ridiculously lenient sentences. Not only are sentences unrealistic and unfitting to crimes committed, but prisoners also get far too many luxuries in Prison during their term time, as my Prison Officer husband would contest to.
Justice seems to be a moot word in this society and I wouldn't be surprised, if we continue in this judicial decline, that there is not an upsurge of vigilantism.
I went to sign the petition but I see the date has passed. Could you post an update of any action that was taken? Or perhaps any other way such people as myself could help out?

Hi Davina, I've only just read your story in an old Take A Break magazine and it reduced me to tears. I want to wish you well in your campaign. Only two weeks ago my 17 year old son saw a 16 year old lad he didn't know very well pick up our own cat by the throat and swing him around, laughing as he did so. Our poor cat's eyes were bulging both with terror and lack of breath. My son lost his temper and threw the perpetrator against a wall by HIS throat and then slapped him in the face. But it was MY son that had to go to the police station to answer to a charge of common assault while the perpetrator didn't even get so much as a reprimand even though there were loads of witnesses in my son's favour. All animal cruelty should have far more severe consequences for the perpetrator. PS: It's a proven fact that serial killers start their 'careers' by torturing and killing animals-the government should therefore take these animal abuses more seriously than they currently do.
